These terms are a contract between you, the business that creates a BonusWallet account, and BonusWallet, whose details are at the end of this page. By creating an account or using the service you accept them. Please read them together with our Privacy Policy.
The service is offered to businesses only. The person creating the account confirms that they are authorised to bind the business.
1. The service
BonusWallet lets you create digital loyalty cards that your customers add to Apple Wallet or Google Wallet, and gives you the tools around them: a dashboard to design cards and rewards, join links and QR codes for customers, a staff scanner to add stamps or points and redeem rewards, automatic and manual messages to your customers, and analytics.
Which features and limits apply to you depends on the plan you choose. We describe them on our pricing page and in the plan manager in your dashboard.
2. Your account and team
- Give accurate information when you sign up and keep it up to date.
- Keep your password confidential. You are responsible for everything done through your account.
- You can invite team members and give them a six-digit PIN for the staff scanner. You are responsible for their use of the service and must remove access when someone leaves.
- You may add as many locations as your plan includes, up to a maximum of ten under one account. Each location must be a real place of business.
3. Plans, fees and billing
- We offer three tiers: Silver, Gold and Platinum. Each is priced per location: a base price that includes your first location plus a price for each additional location, for up to nine additional locations (ten in total).
- You can pay monthly or annually. Annual billing is discounted by 20% compared with the monthly price. The current prices, in euro and excluding VAT unless stated otherwise, are those shown on our pricing page and in the plan manager when you subscribe.
- Fees are payable in advance for each billing period, using the payment methods we make available when you subscribe. If a payment fails or is overdue we may, after notifying you, suspend the service until it is settled.
- You can change tier, billing cycle or number of locations at any time from the plan manager in your dashboard. Changes take effect immediately and the price follows the new configuration from the next billing period, unless we tell you otherwise when you confirm the change.
- We may change our prices with at least 30 days’ notice by email or in the dashboard. Changes apply from your next billing period after the notice. If you do not agree, you can cancel before then.
- There are no setup fees and no fees per customer.
4. Cancellation and termination
- You can cancel your plan at any time from Settings, Plan and billing, in your dashboard. Cancellation takes effect immediately. Fees already paid for the current billing period are not refunded unless the law requires it.
- After cancellation your loyalty program stops; cards already in your customers’ wallets are no longer updated. Your data is kept and deleted as described in our Privacy Policy, and you can export your customer list before you cancel.
- You can delete your account entirely from Settings, Profile, Delete account. This immediately erases your business, team, customers, passes and logo, marks your Google Wallet passes as expired and removes your login. It cannot be undone.
- We may suspend or terminate your account if you materially breach these terms, if fees remain unpaid after notice, or if we are required to by law. We may also discontinue the service with at least 30 days’ notice, in which case we refund any prepaid fees for the period after termination.
5. Your customers and your responsibilities
Your loyalty program is yours. You decide the rules and the rewards, and you are responsible for honouring them towards your customers and for complying with the consumer, marketing and data protection laws that apply to you.
- You are the controller of your customers’ personal data. You must have a lawful basis to collect it, inform your customers about how you use it, and honour their rights and their choices, including unsubscribes.
- Send marketing messages only to customers who agreed to receive them, and do not re-add customers who unsubscribed.
- Only upload or enter data you are entitled to use, and keep your customer exports secure.
- Do not use the service to collect data from children or for any program that is unlawful, misleading or unfair.
6. Acceptable use
You must not:
- use the service to send spam, harassing or deceptive messages, or messages unrelated to your business;
- upload content, logos or names you have no right to use, or that are unlawful or offensive;
- impersonate another business or person;
- attempt to access other accounts, probe or overload our systems, bypass rate limits or security measures, or reverse engineer the service;
- resell or sublicense the service without our written agreement.
We may remove content or suspend accounts that violate these rules.
7. Content and intellectual property
- The BonusWallet platform, its design, code and trademarks belong to us or our licensors. We grant you a non-exclusive, non-transferable right to use it for your business while you have an active account.
- Your business name, logo, colours, card texts and messages remain yours. You grant us the right to use them to provide the service: to render your cards, show them in wallets and send messages on your behalf.
- Passes carry a small “Powered by BonusWallet” mention unless your plan lets you remove it. Every email we send on your behalf carries a “Sent with BonusWallet” line, whatever your plan.
- If you send us suggestions, we may use them without any obligation to you.
8. Apple Wallet, Google Wallet and other third parties
Passes are delivered through Apple Wallet and Google Wallet, which are operated by Apple and Google under their own terms. We do not control those platforms; features such as lock-screen notifications depend on them and on your customers’ device settings. We may adapt how passes are built and displayed to keep them working with those platforms.
9. Availability and changes
We work to keep the service available at all times, but we do not guarantee uninterrupted operation. Maintenance, provider outages and events outside our control can cause downtime. We may add, change or withdraw features; if a change materially reduces what you pay for, we will tell you in advance.
10. Warranties and liability
- The service is provided as is. To the extent permitted by law we exclude all warranties not expressly stated in these terms, including that the service will meet your particular requirements or be error-free.
- To the extent permitted by law, we are not liable for indirect or consequential losses such as loss of profit, revenue, customers or data, and our total liability under these terms in any 12-month period is limited to the fees you paid us in that period.
- Nothing in these terms excludes or limits liability for fraud, wilful misconduct or gross negligence, for death or personal injury, or any liability that cannot be limited under applicable law.
- You will indemnify us against claims from your customers or third parties that arise from your loyalty program, your content or your breach of these terms.
11. Data processing terms
This section forms our data processing agreement under Article 28 GDPR. It applies whenever we process personal data of your customers on your behalf.
- Subject matter and duration: the processing needed to run your loyalty program through the service, for as long as your account exists and until the data is deleted afterwards.
- Nature and purpose: storing customer profiles, issuing and updating wallet passes, recording loyalty activity, sending the messages you configure, producing analytics and exports.
- Data subjects and data: your customers; their name, contact details, birthday, language, loyalty activity, pass and device identifiers, message history and consent status, as described in our Privacy Policy.
- Instructions: we process the data only on your documented instructions, which are these terms and the settings you make in the dashboard, unless the law requires otherwise, in which case we tell you first where permitted.
- Confidentiality: the people who access the data are bound by confidentiality obligations.
- Security: we apply the measures described in our Privacy Policy, including encryption, hashed credentials, role-based access and audit logging, and keep them appropriate to the risk.
- Sub-processors: you authorise the providers listed in our Privacy Policy. We will update that list before adding or replacing a provider and notify you through the dashboard or by email; you may object within 30 days on reasonable grounds, and if we cannot resolve the objection you may cancel. We remain responsible for our sub-processors.
- Assistance: we help you respond to requests from your customers (the dashboard lets you correct data and export your list; ask us to erase individual customers) and, where needed, with security, breach notification and impact assessments.
- Breaches: we notify you without undue delay after becoming aware of a personal data breach affecting your customers’ data, with the information you need to meet your own obligations.
- End of processing: deleting your account from the dashboard erases your customers’ data immediately; otherwise we delete it as described in our Privacy Policy, unless the law requires us to keep it. You can export your customer list beforehand.
- Audits: on request we provide the information needed to demonstrate compliance and allow audits, at most once a year, on reasonable notice, at your cost and without disrupting the service.
- Transfers: data is transferred outside the European Economic Area only with the safeguards described in our Privacy Policy.
12. Governing law and disputes
These terms are governed by the laws of Italy. Disputes are submitted to the courts of the place in Italy where BonusWallet is established. Mandatory provisions of European Union and national law that protect you, including any consumer rights that apply to you, are not affected. 13. Changes to these terms
We may update these terms. For material changes we notify you at least 30 days in advance by email or in the dashboard. If you keep using the service after the changes take effect, you accept them; if you do not agree, cancel before that date.
